2. The Service & AI Nature

2.2 AI Disclaimer

You acknowledge that the Service uses generative AI technologies.

Probabilistic Nature: Outputs are generated based on statistics and probability. The Service may produce inaccurate, incorrect, or "hallucinated" information.
No Professional Advice: The Service does not provide legal, medical, or financial advice.
Human Verification: You are solely responsible for reviewing and verifying any Output before using or publishing it.

3. Account & Security (Magic Links)

3.1 Registration

To access the Service, you must register an account using a valid email address.

3.2 Passwordless Authentication

We utilize a passwordless "Magic Link" or Single Sign-On (SSO) system. We do not store passwords.

3.3 Your Responsibility

You are solely responsible for maintaining the security of your email account. Since possession of access to your email grants access to your Service account, we are not liable for any loss or damage arising from unauthorized access to your email inbox.

3.4 Eligibility

You must be at least 18 years old to use the Service.

4. Subscription & Payments

4.1 Fees

The Service is billed on a subscription basis (e.g., monthly/annually). You agree to pay all applicable fees specified at checkout.

4.2 Taxes

Czech Republic: Prices include applicable VAT.
EU Business (Reverse Charge): If you are a business in the EU (outside CZ) with a valid VAT ID, the tax liability shifts to you (Reverse Charge).
International: You are responsible for any local taxes or duties.

4.3 Cancellation

You may cancel your subscription at any time via account settings. The cancellation takes effect at the end of the current billing period.

5. Intellectual Property

5.1 Our Rights

inithouse.com s.r.o. owns all rights, title, and interest in the Service, including software, code, and trademarks.

5.2 Your Content

You retain ownership of the data you input ("Input") and the content generated ("Output").

5.3 License

You grant us a limited, worldwide, non-exclusive license to use your Input and Output solely to provide and maintain the Service. We do not use your data to train our public AI models.

6. Acceptable Use Policy

You agree NOT to use the Service to:

Generate content that is illegal, defamatory, or promotes self-harm.
Create "deepfakes" or content intended to mislead or deceive.
Reverse engineer the Service or attempt to extract source code.
Use the Service to build a competing AI product.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY CZECH LAW:

INITHOUSE.COM S.R.O. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF DATA OR PROFITS.

7.2

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS.

7.3

This limitation does not apply to damages caused by intentional misconduct or gross negligence, or damages to life and health.

8. EU Consumer Rights (Withdrawal)

8.1 Right of Withdrawal

Consumers in the EU generally have a 14-day right of withdrawal.

8.2 Exception for Digital Content

By purchasing a subscription and requesting immediate access to the Service, you expressly consent to the immediate performance of the contract and acknowledge that you thereby lose your right of withdrawal once access is granted (pursuant to § 1837(l) of the Czech Civil Code).

9. Governing Law

These Terms are governed by the laws of the Czech Republic. Any disputes shall be resolved by the competent courts in Prague, Czech Republic.
